Conflict of Interest

We have had significant contact with a number of independent hospitals regarding whether doctors working in or contracted to provide services to those hospitals can detain individuals under the 2003 Act. Here is our guidance, based on the requirements of the Act and previous recommendations we have made to independent hospitals and to the Scottish Government.
