Learning Disability Census 2010

This is the fourth biennial census of all people with learning disabilities subject to compulsory treatment in Scotland. The 2004 census was conducted in the last year of the Mental Health (Scotland) Act 1984. The subsequent three censuses follow the introduction in 2005 of the Mental Health (Care and Treatment) (Scotland) Act 2003 and reflect the emerging trends of that legislation.

The 2003 Act imposed new general duties on the Commission to monitor and report on the operation of the Act and promote best practice. In addition to our visiting programme to monitor the care and treatment of people with a learning disability subject to the Act, we examine the data held both under Mental Health Act and the Criminal Procedures (Scotland) Act 1995 and produce a census. The census includes all people with learning disabilities subject to compulsory measures in NHS learning disability and psychiatric hospitals, in the State Hospital, in private hospitals and in the community. Information provided by health boards on the census date (17th September 2010) has been compared with the information held by the Commission to ensure accuracy.
