Respecting the rights of the individual
Key message
People's freedom should be respected as far as possible when they are in hospital and there must be clear and regularly reviewed procedures in place when limits are placed on freedom.
Action needed
- All assessment wards for older people must, if the door is either permanently or temporarily locked, have a policy in place for locking the door. This policy should state the reason for this and should include a clear monitoring and review process. It must also address the rights of people who are not detained under mental helth legislation.
- People who what to leave the ward and are able to do so should not have unecessary barriers put in their way.
- The use of technology can help minimise the limits on a person's personal freedom and its use should be consider.
